Outdoor burning in Texas is illegal unless certain
requirements are followed when burning.
□
Trees, brush, grass, leaves, branch trimmings or other plant
growth may be burned ONLY on the property on which the
material grew
□
Burning must be conducted downwind of or at least 300 feet
from any structure containing sensitive receptors (sensitive
receptors include humans and livestock, as well as sensitive
live vegetation)
□
The burning of the following materials is PROHIBITED:

Treated lumber
□
Electrical Insulation
□
Electrical Wire
□
Plastics
□
Furniture
□
Carpet
□
Mattresses
□
Appliances
□
Non-wood construction/demolition materials
□
Construction debris
□
Petroleum products
□
Asphalt materials
□
Potentially explosive materials
□
Chemical wastes
□
Items containing natural or synthetic rubber
□
Tires
□
You can burn no earlier than one hour after sunrise and no
later than one hour before sunset
□
A responsible party must be present while the burn is active
and progressing
□
Burning is prohibited at a time when the wind speed is
either less than six (6) mph or greater than
twenty-three (23) mph.
□
All burning MUST NOT CREATE A NUISANCE OR TRAFFIC HAZARD
Failure to burn in accordance with these rules
found in the Texas Administrative Code, Title 30, Chapter
111, is an offense punishable for an individual by a fine
of not less than $1,000 or more than $50,000, confinement in
the county jail for a period of six months, or both. An
offense is punishable for a person other than an individual
by a fine of not less than $1,000 or more than $100,000.
